The prosecution and defense proposed a court ruling filed Tuesday, September 12, stating that "in light of the ongoing proceedings in the relevant proceedings, it is appropriate to follow 2022 Labor Day." The deputy commander of Theranos has faced the same charges as him. In a court order signed Wednesday, Judge Edward DeVilla, who presided over Holmes' case, began his trial in late September. At that point, more than a year will pass before his trial begins.
Until then, according to the previous prosecution and defense deposit, Holmes remained free, including $ 500,000 in property-secured bonds.
According to the complaint, Holmes faces up to 20 years in prison, a 250,000 fine and a refund for each count. Judge Davila Holmes will use the decision guidelines to make the final decision.

Holmes, 37, was first charged more than three years ago with Ramesh "Sunny" Balwani, a former COO and ex-boyfriend and the failed president of a blood test startup. Their trial was adjourned when Holmes said in a court filing that he would accuse her of mental and sexual abuse and point the finger at Balwani. Holmes testified when he stood up in his defense. Balwani has denied the allegations of abuse filed in the court.
Balwani's trial, originally scheduled to begin this week, was initially postponed due to the length of the Holmes trial (four months with consideration) and the spread of the omicon variant of the coronavirus. In another court filing on Tuesday, the prosecution and defense in Balwani's trial proposed March 9 as the start date for the jury election. Balwani is not guilty.
Holmes, who started Theranos at the age of 19, claimed that he had developed an innovative blood testing technique that could accurately and accurately test a variety of conditions using just a few drops of blood. Once considered the next Steve Jobs, Holmes raised $ 945 million from investors, raised startups to 9 billion in valuations, and made him a paper villain in the process. But his strategy did not work out as he claimed and everything fell apart.
Following a seven-day jury trial, Holmes was convicted of four counts, including conspiracy to defraud investors and three transfer frauds involving a particular investor. The jury acquitted Holmes from a count of plots against three fraudulent patients and one fraudulent patient.
There were three additional transfer frauds involving other investors where the jury failed to reach an agreement unanimously and Judge DeVilla declared a fraudulent trial. The prosecution has indicated that in the proposed joint filing, it will remove these three counts and file a formal proposal to do so by the end of this week.
